That would happen even after Mayor Brandon Johnson welcomed newcomers and the city promised, through the Welcoming City Ordinance and the statewide TRUST Act, to shield most immigrants from deportation. Because both rules say no local worker should assist in noncriminal immigration raids, any cop siding with ICE could face legal action, job discipline, and public anger.
Chicago’s Sanctuary City Policies and Legal Framework
The Welcoming City Ordinance firmly locks in Chicago’s Sanctuary City promise by ordering the Chicago Police Department and every other city office to disregard ICE’s civil immigration work.
Under this law, officers may not:
- Warrant arrest or keep someone in jail just because they lack papers or appear in a federal database.
- Quiz a person about where they were born or pass that information to Washington unless a judge orders it or a clear U.S. rule says they must.
- ICE agents can ask about a person’s custody status, release date, or contact information, and CPD may reply if no criminal warrant is shown.
- City facilities, however, cannot be converted into interview rooms for ICE business without a warrant.
- The Illinois TRUST Act, passed in 2017, shields immigrant neighbors by blocking state and local police from helping with civil immigration cases unless a federal judge has signed the arrest order.
